Privacy policy

Effective Date: August 11, 2025

This Privacy Policy explains how FlyScape (“FlyScape,” “we,” “us,” or “our”) collects, uses, discloses, and safeguards personal information when you visit www.flyscape.co (the “Site”) or purchase our products (the “Products”). By using the Site, you agree to this Privacy Policy and our Terms of Service. If you do not agree, please do not use the Site.

  1. Who We Are & How to Contact Us
Controller: FlyScape. Email: info@flyscape.co. Postal Address: FlyScape, 1703 Moreland Dr, Alameda, CA 94501, United States. We host our store on Shopify, which provides the e-commerce platform we use to sell our Products. Learn how Shopify processes personal information in Shopify’s Consumer Privacy Policy: https://www.shopify.com/legal/consumer-privacy.

  2. Personal Information We Collect
We collect personal information directly from you, automatically from your device, and from service providers. Categories may include identifiers and contact data such as name, email, phone number, and shipping/billing address; commercial data such as items viewed, cart contents, purchase history, and preferences; payment data consisting of tokenized card or payment details processed by our payment processor (we do not store full card numbers); device and usage data such as IP address, device type, browser, cookies, pages viewed, referring/exit pages, and timestamps; approximate location data derived from IP address; and user-generated content and communications such as product reviews, support messages, and social media interactions. If you choose to use authentication or login services (for example, Google or Facebook), we may receive information from those services.

  3. How We Use Personal Information
We use personal information to provide, operate, and improve the Site and our Products; process and fulfill orders, returns, and customer support; personalize your experience and remember your preferences; conduct analytics, quality assurance, and debugging; detect, investigate, and prevent fraud or security incidents; comply with legal obligations and enforce our terms; and perform marketing and advertising, including cross-context behavioral or “targeted” advertising where permitted by law and subject to your choices.

  4. Shopify Network Intelligence and “Enhanced Services”
If we enable Shopify Network Intelligence, Shopify will securely use data from visitors and customers across participating Shopify merchants to power certain features (“Enhanced Services”) that help protect, grow, and improve our business and other Shopify merchants’ businesses. When providing Enhanced Services, Shopify may act as an independent controller of certain personal information. For clarity: we cannot see other merchants’ customer lists, and other merchants cannot access ours; enabling Enhanced Services does not allow other merchants to directly obtain your personal information. For more information about how Shopify processes personal information—including for Enhanced Services—see Shopify’s Consumer Privacy Policy (https://www.shopify.com/legal/consumer-privacy) and Privacy Portal (https://privacy.shopify.com).

  5. Cookies, Analytics, and Advertising
We and our service providers use cookies and similar technologies (for example, pixels and tags) to operate the Site, analyze performance, and personalize content and ads. You can control cookies via your browser settings; if you block or delete cookies, some features may not work. Where required (for example, in the EEA/UK/Switzerland), we obtain consent for non-essential cookies and targeted advertising, and you may withdraw consent at any time using our cookie banner or the “Cookie preferences” link in the Site footer.

  6. Disclosures of Personal Information
We disclose personal information to service providers and processors—including our e-commerce platform, payment processors, shipping partners, analytics, marketing, and customer support providers—who may use the data only to perform services for us; to Shopify (as our platform provider and, where applicable, as an independent controller for Enhanced Services); to law enforcement or pursuant to legal process when required by law or to protect rights, property, or safety; and in connection with business transfers such as a merger, acquisition, or asset sale, subject to appropriate safeguards. We do not sell personal information for money. We may share personal information for cross-context behavioral or targeted advertising as those terms are defined under certain U.S. state laws; see Your Privacy Choices below for how to opt out.

  7. Your Privacy Choices and Rights
    A. Global choices: you can unsubscribe from marketing emails using the link in any marketing email. You can also adjust browser settings and use our cookie banner or preferences control; use the “Cookie preferences” link in our site footer to review or change your choices at any time.
    B. U.S. state-specific rights (for example, CA/CO/CT/UT/VA and others): residents of certain U.S. states may have the right to request access, correction, deletion, portability, to limit use of sensitive data, and to opt out of “sale,” “sharing,” or targeted advertising. To exercise rights, contact us at info@flyscape.co. To opt out of data “sharing” or targeted advertising, visit our Data Sharing Opt-Out page at https://www.flyscape.co/pages/do-not-sell-or-share-my-personal-information (also linked in our footer as “Do Not Sell or Share My Personal Information”). Where available, you may also enable a recognized opt-out preference signal (for example, Global Privacy Control), which we honor as required by law. If we deny a request, you may appeal by emailing info@flyscape.co with “Privacy Appeal” in the subject line.
    C. EEA/UK/Switzerland: if you are in the EEA/UK/Switzerland, you may have rights under GDPR, including access, rectification, erasure, restriction, portability, and objection. Where required, we obtain consent for non-essential cookies and targeted ads, and you may withdraw consent at any time via our cookie preferences tool. You may also contact Shopify directly via its Privacy Portal: https://privacy.shopify.com. Legal bases (EEA/UK only) include performance of a contract (fulfilling orders), legitimate interests (for example, security, analytics, and improvement), consent (non-essential cookies and ads), and legal obligations. Cross-border transfers may occur to countries outside your own; we and our providers (including Shopify) rely on lawful transfer mechanisms such as Standard Contractual Clauses where required.

  8. Retention
We retain personal information for as long as needed for the purposes described above—for example, providing Products, compliance, resolving disputes, and enforcing agreements—unless a longer retention period is required or permitted by law.

  9. Security
We use reasonable administrative, technical, and physical safeguards to help protect personal information. No method of transmission over the Internet or electronic storage is 100% secure.

  10. Children’s Privacy
The Site is intended for individuals 18 years and older. We do not knowingly collect personal information from children under 18. If you believe a child has provided personal information, please contact us so we can delete it.

  11. Third-Party Links and Social Features
The Site may include links to third-party websites or services and social media features. Your interactions with those features are governed by the privacy policies of the companies providing them.

  12. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will change the Effective Date above and post the updated version on the Site. Material changes will be highlighted or otherwise communicated as required by law.
