These Terms of Service (the “Terms”) govern your access to and use of www.flyscape.co (the “Site”) and your purchase of products from FlyScape (“FlyScape,” “we,” “us,” or “our”). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, you must not use the Site.

1. Introduction
   This agreement is a legally binding contract between you and FlyScape. It applies to all visits to the Site and to any order you place for our products.

2. Acceptance of Terms
   The Effective Date of these Terms is the date you first use the Site. Your continued use of the Site constitutes acceptance of the then-current Terms. If you do not agree, stop using the Site immediately.

3. Eligibility
   You must be at least eighteen years old and able to enter into a binding contract to use the Site and purchase products.

4. Changes to These Terms
   We may update these Terms from time to time. When we do, we will update the “Updated” date above and post the revised Terms on the Site. Changes apply on a going-forward basis. Your continued use after changes become effective constitutes acceptance of the revised Terms.

5. Orders and Contract Formation
   Your order is an offer to buy products. We may accept or reject any order in our discretion. We may require identity or address verification or cancel an order if we suspect fraud, misuse, or error. A contract is formed only when we send an order confirmation or tender the order to the carrier.

6. Prices, Taxes, and Duties
   Prices shown at checkout exclude taxes, duties, fees, and shipping unless stated otherwise. You are responsible for all applicable taxes, duties, and import charges. We are not responsible for orders rejected for unpaid taxes or duties.

7. Payment
   We accept the payment methods presented at checkout. We may cancel an order if payment cannot be completed or verified. We may request additional information to validate payment; failure to provide it may result in cancellation.

8. Shipping, Title, and Risk of Loss
   Shipping dates are estimates and are not guaranteed. Delays may occur due to carrier issues, customs, weather, or other events beyond our control. Title and risk of loss transfer to you when we tender the order to the carrier. International customers are responsible for import compliance and assume all risks associated with international shipments, including customs holds or seizure.

9. Returns and Exchanges
   You may request a return within fourteen days of delivery; prior Return Authorization is required. Refunds are issued to the original payment method and exclude original shipping costs. You may request an exchange within twenty days of delivery; Return Authorization is required and you are responsible for return shipping. A restocking fee of ten percent may apply to returns. Used, damaged, or altered items and items returned without required accessories or packaging may be refused or subject to deductions. To start a return or exchange, contact info@flyscape.co.

10. Acceptable Use
    You may use the Site and products only for lawful purposes. You must not interfere with, disrupt, or attempt to gain unauthorized access to the Site. You must not upload or transmit illegal, infringing, defamatory, or obscene material. You must not copy, modify, reverse engineer, decompile, or create derivative works from the Site or products except as permitted by law.

11. Intellectual Property
    All content on the Site, including text, graphics, logos, product names, images, videos, and software, is owned by FlyScape or its licensors and is protected by intellectual property laws. No rights are granted to you except as expressly stated.

12. Shopify Services and Network Intelligence
    Our store is hosted on Shopify Inc., which provides the e-commerce platform we use to operate the Site. If we enable Shopify Network Intelligence, Shopify may use data from visitors and customers across participating Shopify merchants to provide features that help protect, grow, and improve merchants’ businesses (the “Enhanced Services”). In providing Enhanced Services, Shopify may process personal information as an independent controller. Other merchants cannot access our customer lists and we cannot access theirs. 13. Disclaimers
    The Site and products are provided on an “as is” and “as available” basis. Except as required by law or expressly stated in writing, we disclaim all warranties and conditions, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the Site will be uninterrupted, secure, or error-free.

14. Limitation of Liability
    To the maximum extent permitted by law, FlyScape will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Site or products, even if advised of the possibility of such damages. Our total liability for all claims relating to the Site or products will not exceed the amount you paid to us for the product or products at issue in the twelve months preceding the claim.

15. Indemnification
    You agree to defend, indemnify, and hold harmless FlyScape and our officers, directors, employees, and agents from and against all claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Site or products or your violation of these Terms or applicable law.

16. Governing Law and Venue
    These Terms are governed by the laws of the State of California and the United States without regard to conflict-of-law principles. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Alameda County, California, for any dispute that is not subject to arbitration or that cannot be filed in small claims court.

17. Term and Termination
    These Terms remain in effect until terminated. You may stop using the Site at any time. We may suspend or terminate your access to the Site immediately for any reason, including violation of these Terms. Provisions that by their nature should survive termination will survive, including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law.

18. Miscellaneous
    These Terms, together with our Privacy Policy and any additional terms presented at purchase, constitute the entire agreement between you and FlyScape and supersede prior or contemporaneous agreements on the subject matter. If any provision is held invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign these Terms without our prior written consent; we may assign these Terms without restriction. You consent to receive communications from us electronically and agree that all terms, notices, and disclosures we provide electronically satisfy any legal requirement that such communications be in writing.
